PREAMBLE

The present General Terms and Conditions of Sale govern the relationship between - SARL JENMO, a limited liability company with capital of €10,000, having its registered office at 9 rue la Praya, Parc d'entreprises, 33950 LEGE CAP FERRET, registered in the Bordeaux Trade and Companies Register under no. 827 745 852 - and customers wishing to make a purchase from the horizons-lointains.fr website.

Horizons-lointains.fr (SARL JENMO) mainly sells, through its online sales site, ready-to-wear items, fashion accessories, shoes, jewelry and small decorative items.

SARL JENMO reserves the right to adapt or modify the present General Terms and Conditions of Sale. In the event of modification, the conditions in force on the day of the order will be applied to each order. These conditions apply exclusively to non-trading customers.

ORDER

All orders imply full acceptance of these General Terms and Conditions of Sale and will only be taken into consideration once payment has been accepted.

  • All orders delivered in France are payable in Euros (€).
  • All orders delivered to other countries are payable in the currency of the country.

Horizons-lointains.fr undertakes to honor orders received within the limits of available stocks and in the event of unavailability (following a possible stock error) to inform the customer by any means at its convenience (email, telephone); the customer may then cancel the order and be reimbursed, where appropriate, the sums already paid. Horizons-lointains.fr reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.In the event of an order to a country other than metropolitan France, the buyer is the importer of the product(s) concerned. For all products shipped outside the European Union and French overseas departments and territories, customs duties, other local taxes, import duties or state taxes may be payable. Horizons-lointains.fr is not responsible for these charges. They will be charged to the customer and are your sole responsibility, both in terms of declarations and payments to the authorities and competent bodies in your country.

SHIPPING

Delivery methods :

For France, our deliveries are handled by Colissimo and Chronopost.
For the rest of the world, our deliveries are handled by DHL.

In the event of an error in the customer's contact details, Horizons-lointains.fr cannot be held responsible for the impossibility of delivering the item(s) ordered.

Delivery date :

Horizons-lointains.fr undertakes, subject to payment, to do its utmost to respect the delivery deadlines mentioned on the "Delivery rates" page. Delivery times are given as an indication only, unless we indicate "guaranteed delivery". In the case of delivery times given as an indication, we cannot be held responsible for the consequences due to a delay in delivery or loss of the parcel caused by a third party to the contract or by you, or due to an unforeseeable and insurmountable cause constituting a case of force majeure.In the event of non-receipt of a parcel within the times indicated, an investigation is carried out with the carrier and may take several days. During this period, no refund or return can be made.In all cases, if the package is returned to the sender, a second delivery will be made at the customer's expense.No dispute relating to the delivery itself is possible if the package appears to have been delivered, the carrier's register being taken as proof.Any package showing anomalies or being opened when handed over to the customer must be the subject of a written reservation at the time of collection and be declared within 3 days of the date of delivery to customer service (contact@horizons-lointains.fr).

Horizons-lointains.fr undertakes to inform the customer by email of the progress of his order and its delivery. However, it is possible that technical incidents may occur.

PRICING

  • For France, prices are given in Euros (€) and include all taxes (TTC), but exclude shipping costs. The latter are at the customer's expense.
  • For all other countries, prices are quoted in the local currency. We clearly indicate whether tax is included or not.

PAYMENT METHOD

Payment must be made in full at the time of ordering. At no time may the sums paid be considered as deposits or advance payments.

  • In France: customers may pay by credit card via Stripe (secure online payment solution), via Klarna (payment in 3 instalments without charge) or via a PAYPAL account.
  • For other countries: customers will see payment methods adapted to their country.
    In order to offer you Klarna's payment options, we may need to transfer your personal data to Klarna, including your contact details and order details, so that Klarna can assess whether you qualify for them and tailor them to your needs. Your personal data will be treated in accordance with Klarna's privacy policy.

For a transaction by credit card, the customer will indicate the number appearing on the front of his card, the expiry date of his card and the cryptogram appearing on the back of his card (last 3 digits). Horizons-lointains.fr has no access to your credit card details and will not store them at any time. They are encrypted on your computer and then transmitted in unintelligible form to our partner's servers, which are the only ones capable of decrypting them. Each time you use one of the pre-registered cards, you will be asked to re-enter your account password.

The communication by the customer of his credit card number constitutes authorization for Horizons-lointains.fr to debit his account up to the amount of his order. No cash-on-delivery shipment will be accepted, whatever the reason.

Horizons-lointains.fr retains ownership of the item until full payment has been received from the customer. The payment solutions adopted by our site are 100% secure. These solutions make it possible to protect the information that customers communicate to us and guarantee the conformity and security of each transaction.

In addition, to combat fraud, our site has set up a system using exclusion lists, which may lead us to:(I) request certain supporting documents once payment has been made, in order to secure the transaction, in the event of an automatic alert triggered by information relating to your order.(II) block an order if the customer account has already been used to commit fraud.

ITEM DEFECT

Horizons-lointains.fr is liable for defects in conformity of the product with the order and for hidden defects under the conditions set out in articles 1641 and 1649 of the French Civil Code. In accordance with the provisions of order no. 2005-136 of February 17, 2005, the aforementioned articles of the French Civil Code and the articles of the French Consumer Code relating to the guarantee of consumer goods are reproduced in these General Terms and Conditions of Sale.

When an article is defective, we propose either to exchange it, if our stocks allow it, or to refund the defective article as well as the return costs. However, horizons-lointains.fr will only refund the return shipping costs if the customer returns a defective item alone. In the event that other items are returned that are not suitable for you, we will not cover your return shipping costs.

RETURNS OR DAMAGED PARCEL

In accordance with current legislation, if the customer is not satisfied, he/she has a legal period of 14 days (as evidenced by the postmark) to return the item(s) ordered. All parcels postmarked after 14 days will be refused.) from the date of delivery to return the item(s) ordered, in accordance with articles L121-20 et seq. of the French Consumer Code, without justification, and obtain a refund of the sums already paid for the item(s) purchased. Return of items for damaged parcel: In the event of receipt of a damaged parcel, please contact us as soon as possible contact@horizons-lointains.fr to report the damaged parcel. To identify a damaged parcel, take photos of the parcel before and after opening, and send them to us by e-mail at contact@horizons-lointains.fr, specifying the order number and the subject of your e-mail.

The returned item will be exchanged or reimbursed to the customer within a maximum of 15 days of receipt. In the event of a returned item that does not conform in all respects to the item shipped, Horizons-lointains.fr reserves the right to carry out a more detailed analysis of the returned item. Under no circumstances will the customer be entitled to claim a higher refund for this additional delay. Reimbursement will be made by crediting the amount of the item to the bank account of the credit card used by the customer or to the customer's PAYPAL account.

RETURNS AND REFUND CONDITIONS

Products that are the subject of a retraction must be returned in their original packaging, with the original labels intact and attached, to the following address:

If the customer makes use of this right of withdrawal, the products must be returned in their original packaging, in perfect condition (new and fit for resale), with all accessories, instructions and original labels intact and attached.

Within the framework of this right of withdrawal, returned products must have been subject to minimal use, and must not bear any traces of use, washing or perfume.

Please note: Items returned incomplete, damaged, used or soiled cannot be taken back. Return shipping costs are at the customer's expense. Reimbursement is due within fifteen days of receipt of the return.

DISPUTES AND APPLICABLE LAW

These terms and conditions of sale and use of the site are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. The prior search for an amicable solution does not interrupt the time limits for taking legal action.

The essential characteristics of the articles are presented on our site: Horizons-lointains.fr, in each of the "product" sheets. The customer is fully informed that the images, photos and colors of the items offered for sale may not correspond to the actual colors due to the effect of the Internet browser and the screen used.
